FORMAL HEARING
If your driving privileges were suspended because of a DUI, you will need to have a formal hearing. A hearing officer presides at a formal hearing at which both testimony and documentary evidence, is heard. The officer is authorized to rule on all motions, administer oaths, subpoena witnesses or documents at the request of any party, examine witnesses and rule upon the admissibility of evidence. At a formal hearing minimum requirement documents must be submitted in a timely manner. An evaluation or a uniform update report, no more than 6 months old and documents of abstinence and support, no more than 45 days old must be submitted at the hearing. Failure to meet Secretary of State minimum requirements, will will automatically result in a denial. An order reflecting the recommendation of the hearing officer and the decision of the Secretary of State is issued. If your privileges are reinstated, you must go through a 12 months probationary period during which a BAIID device will be installed in your vehicle. During that time, you cannot register positive for alcohol or your driving privileges will be automatically suspended. After successful completion of your probationary period you may apply for a full driver license reinstatement.
